Who we are
ScaGrow is a marketing agency based in Kerala, India, providing advertising, website and automation services to businesses across India. In these terms, “ScaGrow”, “we” and “us” mean ScaGrow; “you” means anyone using this website or the client dashboard.
By using this site you accept these terms. If you do not accept them, please do not use the site.
Using this site
You may read this site, book a call and use any tool we make available to you. You may not:
- attempt to gain access to any account, system or data that is not yours;
- copy, scrape or republish the content of this site for a competing service;
- interfere with the site's operation, or attempt to disrupt it for others;
- use the site for anything unlawful, or to send anyone unsolicited marketing.
We may suspend access to the site or the dashboard where we reasonably believe it is being misused.
Dashboard accounts
Client dashboard accounts are created by us for clients we have an existing agreement with. There is no public sign-up.
You are responsible for keeping your password confidential and for activity under your account. If we have set an initial password for you, please change it after your first sign-in. Tell us immediately if you think someone else has access to your account.
Your dashboard shows only your own data. We may suspend an account where an invoice is significantly overdue, or where an agreement has ended, after telling you.
Services and quotes
Prices shown on this site are indicative starting points, not offers. The work we will do, and what it costs, is set out in the written proposal and services agreement we send you, and nothing on this page overrides that document.
Anything outside the agreed scope is quoted separately, and we will not begin it until you have approved the quote in writing.
Payment
Fees, payment terms and any interest on late payment are set out in your services agreement. All fees are exclusive of GST and other applicable taxes, which are charged additionally at the prevailing rate.
Where we send a payment link or a UPI QR code, it is a request for payment and not a receipt. A payment is confirmed only when it appears in our bank account. Please quote the reference shown on the payment page so we can match it to your invoice.
Advertising spend paid to Meta, Google or any other platform is separate from our fees unless your agreement says otherwise.
Intellectual property
The ScaGrow name, logo, this website and its content belong to us. Nothing here transfers any right in them to you.
Work we produce specifically for a client — ad creative, copy, landing pages and other deliverables — transfers to that client once they have paid all sums due under their agreement. We keep ownership of what we bring to the work rather than make for it: our templates, internal tools, dashboards and processes.
Advertising accounts, business pages, domains and analytics properties belong to the client throughout, whoever set them up.
We may show work we have done in our portfolio and marketing, and name a client as a client, unless that client tells us in writing not to.
No guarantee of results
We do not guarantee any particular level of sales, revenue, enquiries, rankings, reach or return on advertising spend. Anyone in this industry who does is guessing.
Results depend on things outside our control: your pricing, your offer, your service quality, how fast you respond to enquiries, competition, seasonality, and the policies and algorithms of advertising platforms. What we undertake is to apply reasonable professional skill and care, and to report honestly on what the numbers show — including when they are poor.
Any figures shown on this website are illustrative unless explicitly described as a specific client's results.
Third-party platforms
Our services depend on platforms we do not control, including Meta, Google, WhatsApp and payment providers. We are not responsible for their acts, including account suspension, policy changes, ad rejection, price changes or downtime.
This site links to third-party services such as our booking calendar. Their terms apply when you use them.
Liability
Nothing in these terms excludes liability for fraud, or for anything the law does not allow to be excluded.
Subject to that, this website is provided as-is. We do not warrant that it will be uninterrupted or error-free, and we are not liable for loss arising from your use of it.
Where you are a client, our total liability is limited as set out in your services agreement. We are not liable for loss of profit, loss of business, loss of anticipated savings, or for advertising spend that did not produce a return.
Changes
We may update these terms. The version on this page is the one that applies, and the date at the top tells you when it last changed. For clients, changes here do not alter a signed agreement — that can only be changed in writing by both parties.
Governing law
These terms are governed by the laws of India. Subject to any dispute resolution clause in your services agreement, the courts at Ernakulam, Kerala have exclusive jurisdiction.
